Open Government: Public interest draft regulations should be discussed at a special resource

Despite the fact that the mechanism of public discussion of legal acts was launched, its work cannot be characterized as stable and smooth, says Mikhail ABIZOV

Public interest draft regulatory legal acts should be discussed on the portal www.regulation.gov.ru in a separate section or on a special resource; the ministries should intensify public involvement in such discussions, and strictly comply with the order and the procedure of publishing of draft regulations, and in case of breach of procedures to punish the responsible. The system is public discussions should be brought in compliance line with the Law “On public control” recently signed by the President of the Russian Federation. These proposals were discussed on July 24th at the meeting of the Government Commission for Open Government Coordination, which also approved the creation of the document (standard or Code) regulating public discussions.

“Despite the fact that the mechanism of public discussion of regulatory legal acts was launched, its work cannot be characterized as stable and smooth. There are examples where discussions are qualitative; sufficient time is given to conduct them, substantive work is conducted with reference groups. Unfortunately, such cases are rare today. It is necessary not only to declare the public about the documents developed by the Government, but most importantly through a feedback mechanism to improve the quality of these documents,”- said the Minister of Open Government Mikhail ABIZOV.

Public discussion of draft legal acts developed by the Russian Government became mandatory under the Presidential Decree of May 7, 2012 № 601 “On Main Directions of Improving Governance”. The Decree stipulates the provision of at least 60 days for public consultations, use of other sites to conduct them and publishing summary of the consultations results on a single resource. Following the message to the Federal Assembly of the Russian President in 2013 he also instructed the Government to submit proposals to improve the mechanism of preliminary consideration of socially significant draft regulations involving civil society institutions. The corresponding report was prepared by the Ministry of Economic Development; the proposals were discussed at the meeting of the Government Commission. Following the discussion, the report was submitted to the President.

Michael ABIZOV proposed to carry out an analysis of publishing draft regulations by the government, identify violations and punish the responsible.
