A 3-year ban on planned inspections of small business

The Governmental Commission approved a 3-year moratorium on planned inspections of small business. The document bans conducting planned inspections from January 1, 2016 until December 31, 2018.

According to the website of the Cabinet of Ministers, amendments to the law of December 26, 2008 № 294-FZ “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs during state control (supervision) and municipal control” were prepared on commission on implementation of the Message of President of the Russian Federation to the Federal Assembly of the Russian Federation on December 4, 2014.

“This will reduce the number of planned inspections and will help create favorable conditions for development of small business in Russia”, - noted the representatives by the Government of the Russian Federation.

According to the supplementary materials to the draft “in case there is information that, in regard to these SMEs a decision on administrative punishment for committing gross violations of Russian law or an administrative penalty of disqualification or suspension of the administrative activities or suspension and (or) the cancellation of the license has come into force and less than 3 years have passed after the inspection which resulted this decision, the state control authority, municipal control body during the formation of an annual plan of scheduled inspections may decide to include in such persons into the inspection plan”.

“In order to ensure safety of life and health of citizens it is proposed not to extend the ban on regular inspections on legal entities and individual entrepreneurs engaged in activities in regards to which, in accordance with the law “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in during state control (supervision) and municipal control” regular inspections can be conducted two or more times in three years”, - reported in the Cabinet.

Such activities include those in field of health, education, social sphere, heating, electricity, energy conservation and energy efficiency if they are on a list approved by the Government of the Russian Federation.

In addition, it is proposed not to extend the ban on inspections of legal entities and individual entrepreneurs in the following types of state control: industrial safety, the safety of hydraulic structures, operation of facilities that have a negative impact on the environment and ensuring radiation safety and protection of state secrets.
