Vladimir Putin approved the fourth antimonopoly package

Russian President Vladimir Putin approved the fourth antimonopoly package. The relevant document amending the Federal Law of 26 July 2006 № 135-FZ "On Protection of Competition" and some legislative acts of the Russian Federation is published on the official portal of legal information.

The law, in particular, prohibits unfair competition related to the use of someone else's intellectual property, substitution or the use of similar trademark, and illicit receipt and disclosure of confidential information.

In addition, the document provides for establishment of a collegial body within the structure of the Federal Antimonopoly Service, where it will be possible to appeal against the decision and directives of territorial antitrust authorities.

At the same time the document makes a number of amendments to the Administrative Code of the Russian Federation, which raise the fine imposed on officials when their actions lead to a restriction of competition and freedom of economic activity to the amount of 50 thousand rubles. If such officials have previously been subjected to the administrative punishment for the same offense, the law provides for up to 3 years of disqualification for them. In addition, it establishes the administrative responsibility for violation of tender procedure, sale of state or municipal property, procedure of contracts conclusion after tender procedures. Along with this, the amendments provide for mitigating administrative responsibility for persons assisting in the investigation of antitrust violations.
